Why would you want to??
I'm sure that'd have to be coded at the dealer, and they might not even do it for you unless you bought it through them for fear that you stole the car and just bought a random ignition module

sure i agree with you about stolen worried,,
sometimes when i insert the key the switch door not open properly, same as when i remove the key, door not close(still in open position).....!?!?!

What about replacement of the ESL unit? I have a brand new OEM unit coming from Germany, does that need programming or just install it and it works?

ECU + EIS + ESL + Key they're all paired. If you need to do a quick straight swap into your vehicle, make sure you get all these components from the donor vehicle.
I've just done this process the other day on a w210 and worked with no problems.
Note: you need to remember that once this swap is done, any replacement key or any ignition component issued by the dealer for your car will not work anymore.
If you need to replace only one component from the ignition, it will require programming for your car. Most likely the dealer will program only brand new parts purchased thru them.

This ESL has never been fitted to a vehicle, and they seemed to be of the belief it could be fitted straight to the car and would operate correctly, and after 40 starts it would be permanantly locked to my car. They said once that happens, it wont work in any other car without programming. This 40 starts thing is what im interested to know about.
This is not the keys or the EIS, i still have all 3 original keys and theyre perfectly fine.
This is only the steering lock, and it is BRAND NEW, never used or installed.

Did the dealer ask you for the VIN number when you ordered the ESL?
I don't know if ESL falls within the "40-starts" category, but you might as well try it if you already have the new ESL. Don't worry about installing it in place, just plug it in and try to start the car to see if the new ESL reacts.
If it doesn't work, your car won't even start.
From what i've been reading, the "40 starts" thing always refers to the ECU - EIS pairing and ESL is not always specified since it looks like the ESL is still an option for DAS3 authorization. Yet, i've never seen a car equipped with DAS3 and not having an ESL.
Still, even in this case, the ECU and EIS must be variant coded before installation and after 40 starts these will be married forever and there is no factory procedure to undo it. Some documentation says that if you cut power to the ECU for about 30mins you might be successfully reset the counter if 40 starts have not been reached yet... but this is a different story than your issue.
Let us know if the new ESL works....

Yes they checked the VIN, and found i also needed a bolt kit, so that is with it too.
It hasnt arrived yet, but when it does ill give it a try.
The supplier i bought it from said they couldnt find any info that said it needed programming, they were not really certain though either.
Info about this part seems very hard to find, so itd be good to have someone that has done this and knows for sure!

Let's see how it works in your case.
Either way, ESL is not a major issue in any MB. You can find easily for cheap ESL emulator to fool the ECU and EIS so you can bypass completely the ESL with these type of devices:
