Why couldn't MB figure it out?
If anything, just unplug the battery and let it sit for a few mins, then reconnect it, see where it goes from there.

no idea he took it for a test drive and all he said dont drive it. I asked for a loaner then said they dont have any to give me so i had to choice but to drive home. I just dont want the tranny to get messed up.
And i just disconnected the battery ill let it sit now.

What dealership is this. They sound horrid. All the MBZ dealers here will get you a rent a car if they don't have an in house loaner and they tell you not to drive your car. Talk to the service manager.

The most obvious answer is the most likely answer.. have you spilled any food, water or sticky soda's (beer???.. I certainly hope you don't drink and drive, that was more of a joke) on the tranny control button that switches between the modes.
If so, it is most likely shorting the button, which is what buttons do and causing the ecu to change modes..
Of course if you did not, it could still be the button failing, which is the most likely option due to the fact that if it was any of the ECU functions that control the tranny, odds are it would also be affecting other aspects of the vehicle.

Most likely it's a faulty solenoid switch. If it is the tranny, it's covered under warranty so no worries there. But the dealership not being able to help is crazy. You need to be a little more forceful, and talk to the service manager for resolution.
