Ok so I did a trans service because of poor shifting and I found the filter sitting in the pan.
New filter fit tight and required firm push for it to click in place
I'm thinking old filter was not installed properly and maybe sucking in air around filter tube causing occasional odd shifts
Shifts are better now, so make sure you remove the old filter oring and push in the new filter until it seats or clicks in place

now, if shifting is better - old fluid was one reason for the bad shift quality- no doubt. but sucking occasionally air would not be one of your underlying problems for sure.
