If you have an illegal, unregistered gun in the house.....

If you have an illegal, unregistered gun in the house.....and someone breaks into your home - and you take this illegal unregistered gun and put a bullet in the thief's head, killing him....

Whats the ramification?

Lets say this is in New York City...

Chucky, how many bullets did you fire?
Did you hit the target?
Is the target alive?
I need to hear more...

Likely mansalughter, illegal possession of a firearm, and public discharge of a firearm by the state. Then the family of the thief would likely file a wrongful death civil suit.

Gotta love modern law

So a good honest hard working republican that lives in liberal communist new york, gets robbed by a possibly republican, possibly liberal, definitely dead criminal and protects him self with a hand gun that he has the god given right to own, in a liberal city that illegally restricts a honest hard working republicans right to defend him/her self from possibly republican, possibly liberal, definitely dead robber, could expect to spend probably years or at least months in prison for defending them selves from possibly republican, possibly liberal, definitely dead robber.

Remove the bullets from the body, clean up casings and get rid of them so the police can't find them. Then pull out the nail gun from the garage and place next to body along with a few pieces of wood. No one will ever know the difference.

If the gun is old enough it might not need to be registered.

In your state Brad-a lot of trouble-even if you were in the "right". Having a gun that isnt yours-and isnt registered (if your state makes you do that-MN does not-they track purchase only-which is my wife)-your going away. Granted-I carry a gun every where I go (and places I shouldnt too)-and I know when I shoot someone Im getting arrested and going to jail for some period of time.
My advice-and I'm okay going to prison (again) if it means I or my wife is alive because of my actions-keep the gun-dont tell ANYONE-and pray you dont have to use it too soon.

Why not just register the gun... Or purchase one legally and defend your property as you see fit, under the law.

First post in OT since Eldritch unceremoniously left the party. :(

Have you reason to feel threatened, Bradley? Certainly your doorman keeps the undesirables at bay, yes?

Not familiar with NYC’s regulations, although “unregistered” and “illegal” are not necessarily synonymous ’round these parts. Whither Bernhard Goetz? California’s draconian statutes are certainly not to be trifled with. As such, each and every piece of hardware in my in my Second Amendment collection has been legally obtained. That the authorities have zero knowledge of them during legitimate stewardship is no fault of mine. I’ve no qualms about defending my family against the hapless criminal who chooses to invade this abode hell bent on doing deadly harm. Hypothetically.

I don't think the right to bear arms is God given.

I suppose that if you equate unalienable with god-given then it is. Not everyone makes that jump.

Just wanted to clarify that I get the point of Lurking Thanks, and that this side discussion of whether all unalienable rights are god given or not doesn't affect his comment at all or add to them, so I'll just stop.

Not where anyone's from.

As far as I'm concerned, the risk of having an unlicensed firearm around isn't worth it. Even as a gun control advocate, I recognize how twisted our laws are in the sense of protecting low life criminals even in the context of you having to use one on one. However, Jail doesn't sound fun, and I certainly wouldn't like to go there, especially due to action taken on said low life, so best bet would be to have the weapon legally.

Hiding the body is not as simple as it may sound. Sooner or later it will come up unless you vaporize it with explosives or pass through a shredder. Throw a nail gun is not smart idea either, anyone who has seen a gun wound will easily distinguish it from non-firearm.

Chucky, no matter what the situation may be, if you shot the bad guy make sure he is absolutely positively dead. In the court it usually his word against yours and NY is famous for siding with bad guys against the home owners. Eventually, if the intruder is dead, who is to say that it wasnt his gun? He dropped it during the fight and you just grabbed it and shot him for the fear of your life.

Eh, what?

1) What kind of gun are we talking about here?
2) If it is unregistered and the state doesn't know you own it, clearly the intruder brought it in with him, was disarmed, and dispatched with the evil implement of death that he himself inflicted upon your peaceful cowering and properly defenseless home.
