Only bottom portion of rear tail light assembly brakes?

Only bottom portion of rear tail light assembly brakes?
I was following my C300 today, and it struck me how the brake lights on it aren't very noticeable.
Is it correct that only the bottom red portion of the light assemblies in back light up? The top red section on either side doesn't have brake lights up there?
I wasn't too impressed, when following my car, in this respect, the rest of it looked good of course ha-ha.

I thought I read somewhere that the red LEDs (turn signals) also light up when the brakes are applied?
Maybe that's the world standard and we lost that when the feds didn't certify the flashing brake lights?
If this "only the bottoms light up" is true, then it would partially explain any "tailgating" from those behind when you hit the brakes hard. Ugh. And especially if it's the bottom portion, since those SUV drivers can't see that far to the ground.
