Improper Muffler Ticket in Downtown Toronto

I was just wondering if anyone else got a ticket like this? The popo pulled me over using his bi-cycle and told me my exhaust is too loud. I told him my exhaust is stock and it comes like that from factory ( I have a letter from Mercedes stating that), he tells me he is not here to argue, and proceeds to fill in a ticket, hands me over a ticket for improper muffler and told me my options are listed behind the ticket and then pedaled away. Of course fighting this ticket is a no brainier. I am just wondering if anyone else faced the same problem?

It'll be an easy win in court with your letter.

But it is an HTA ticket, so will go into your record and cause an insurance bump.

May be a little bit haha. I was way under the speed limit though. Just 1 and 2nd gears.

Wait. Are you saying that if you go to court and the case is dismissed it stays on your record???

No no, I meant if you just pay it, it will go to your record. So it is worth fighting even if you have to take time off work.

Ok. I was trying to figure that one out. Thanks for clarifying. I've often wondered about this scenario myself, I know I'm going to get pulled over at some point but being that it's stock I'm not sure if they can win in court or not. I feel like I read somewhere that cars like the 5.0 mustang have some kind of disclaimer that in "race" mode or whatever it's called that it's not street legal for sound in certain jurisdictions. Could be wrong, not sure.

You need a recent letter from a local MB dealer stating not only that it's stock, but it's functioning properly. Otherwise the judge may rule it's defective.

California recently passed a stricter loud exhaust law. An immediate fine is issued instead of a fix-it ticket.

Does it have to be the dealer? Dont want to take my JB4 out again.

I would. You want an air-tight case. The judge may view a third-party shop with skepticism.

You really think they will open the hood if you just need a letter for the PE?

zibby43 06-18-2019 02:21 AM

Man, that's brutal.

Where I live, I could fly an Apache down Main Street and the cops would just give an approving nod.

If I tell them to certify that the car is stock they might. Dunno. I will give the dealership a call today.
