Transmission has been serviced but
Transmission has been serviced but it has been 50k
Would that cause a winning sound and it apears to be stuck in 3rd or maybe second gear but I think third
Should I get engine light on this type of problem?

A whining noise from the tranmission, engine rpm dependant and starts only after driving a for a little while (10-30mins) are starts performing eradic shifts once it starts whining is a classic symptom of a blocked transmission filter. The whining is cause by oil stavation of the oil pump and the erractic shifts is caused by low oil pressure.
Drop the pan, drain the torque convertor if you have drain plug on it, replace the filter and add a magnet in the pan if you don't already have one. Refill with fresh genuine transmission fluid.
Repeat this preceedure in at your next service.
The usual cause of the blocked filter is excessive amounts of clutch linings in the oil from normal wear and tear. I can also be a sign that the torque convertor clutch is failing as this wears quite rapidly in comparison the the rest of the clutches.
If you change the oil, you have a good chance of keeping the transmission servicable for a while yet. If the transmission doesn't stop whining or starts again before you change the oil next then it's too late to salvage, time for a rebuild.
