Is the ABS module of mercedes E350, model 2006, factory defect

Is the ABS module of mercedes E350, model 2006, factory defect

mercedes E350, 2006.
I am concerned if the ABS module is a factory defect and subject to sudden catastrophic failure.

Similarly a defective Balance shaft is eroding as shown on scanner test. Please refer to mercedes medic.com

Who is responsible for the cost of parts replacement and repairs.

For a 12-year old car? You're going to be responsible.
