Tracking device installed catches mercedes dealer abusing car

I was away on business a couple weeks ago. Prior to going on the trip, I dropped my new GLK off at the Mercedes dealer to have them install the front license plate bracket and check out the front window for some squeaking noise. I left my car with them for a few days without batting an eye.

So a couple days after I dropped the car off, I'm still away and I start getting emailed alerts on my cell phone saying my car is traveling @ 94MPH. I have a tracking device installed in the vehicle which sends alerts in real time. I have it set to send alerts when my vehicle is going over 78 mph.

So after I get the alert that my car was going 94 MPH, I log into the tracking system to see what's going on. I notice the car has been used for the past 24 hours for personal use. The car was parked overnight at a residential address. The car was parked in a mall parking lot for 2 hours. The car was parked in a random empty parking lot for 20 minutes. The car made another stop at a residential address. Who knows what the person was doing while driving my vehicle??

If the tracking device wasn't installed in the vehicle I wouldn't have known any of this was going on. It turns out that something was stolen from the car and my seat was ripped. The dealer cut me a check for the missing device and said they would replace the seat. Also, they said the next maintenance was on them. That's great they want to take care of the damage and lost items their dealership caused but I'm wondering if I shouldn't take this a step or two further.

I have all this documentation printed out as proof and I'm wondering what course of action I should take, if any. I'd appreciate your feedback as to what you think I should do. I definitely feel violated every time I step foot in the car. Thanks.

Man, that sure deserves to be made bigger. Nobody gets to manhandle your car in that fashion. Its pretty much a personal choice though.

I think they owe you a whole new car, or free service as long as you own it. They put abuse on it that can't be undone and who knows what kind of problem could show up in the future as a result of their driving. Try to get more out of them by threatening to go to court, and if they won't give you anything else, then you should go to court. It's not too late.

I would not stand for that, for what you wanted done the car don't need to be test drove at all period, just brought into the shop and repaired, had you taken it in for an high speed vibration then the speed and test drive would be in order and he could have stopped at the mall for a minute to pick up an perscreption and dropped it off for his sick wife/mother or whoever still not the best but at least you could feel for him in a way but joy riding I would have my lawyer make a call to the service manager or owner of the dealership in a minute.
