2nd row power seat warranty question
Hi,
Is the motor for the 2nd row powered seat covered under warranty? My 2nd row seat will not flip all the way forward. Most of the time, it'll just flip down upon pressing the button but not lift up and out of the way. I took it in twice and finally they agree it is an issue with the motor. Unfortunately I was told under the CPO warranty, it does not cover the motor. Mercedes is offering to pay for the part and I am responsible for labor which is still close to $400.
I looked for the CPO coverage and item 16, states the following. It says "all electrical motors". How do I go about with this?

Electrical Systems: Ignition coils and secondary wiring, starter system components, as well as all electrical motors, wiring harnesses and connectors, starter lockout switch, sending units, sensors, switches, fuse boxes, relay modules, control modules, transmitters, instrumental panel, gauges, rheostats, potentiometers, blower motor series resistors, alternator pulley, voltage regulator, diodes, buzzers, horns, actuators, timers, electro-mechanical valves, solenoids, as well as air bag contact plate (located in steering wheel), heated seat elements, and global positioning system (GPS).

The dealership (Mercedes) called Mercedes for the claim and was told it was not covered but they (Mercedes) will pay for the part but I am responsible for labor.

I would recommend a call to MBUSA customer care and verifying what the dealer is telling you. If they say that the motor is covered under CPO warranty I would find another dealer for this and future service

Despite telling them the CPO warranty, line 16 says "all electrical motors", they are insistent it is not covered. Any Mercedes dealers rep here can chime in? Fabbrisd1?

Thanks fabbrisd1. I got your reply. As a summary, I received the car back and paid roughly $400 for the labor. I'm following up with Merc CustCare as to why that part is not covered. I've spoken to them over the phone twice but haven't heard back since. I asked them to explain why despite the warranty paperwork saying "all electrical motors" are covered, they are insistent there's an exclusion.
I feel I can just file a suit in my local court stating breach of contract. I'm sure I can find some sample civil suit and cut/paste.

An update .. after a few back and forth calls, MB cust service cannot tell me why it is not covered, so they are covering it. Despite them having changed the motor, it wasn't working still. I brought it back again 2 weeks ago. They think it needs some lubrication as I showed them if I push down on the seat as it is coming down, it does flip up ok. So, they lubricated, we tested a couple of times and it was working. Drove it home, parked it. Press the button and not working again
I'll live with the issue. Perhaps next time when I bring it in for service, I'll have them look at it .. should still be covered under the original repair since it was never fixed to begin with.
