U.S. Diesel Agreement w/ MB

Apologies if this has been covered - couldn't find anywhere and apologize for the length of this post. I own 2014 GL350 w/ ~90K miles. Had emissions "recall" work done in March, 2021. Before a recent ski trip, I took vehicle (to MB dealer) in for 90K service and check engine light. They indicated check engine light was for EGR "switchover valve" issue (but they didn't have part in stock). I drove it on ski trip, where it went into "limp mode." Took back in when I got back and they replaced the switchover valve (and a related seal), but then diagnosed the EGR valve as faulty. (I did not know there was both an "EGR switchover valve" and an "EGR valve." The technician says is not a matter of clogged/restricted flow, it is electrically dead. Apparently this part is on backorder and none available in U.S. or Germany. The dealer has no indication when this part will be available.

My question is - is anyone familiar with the details of the diesel consent decree agreement that can help on a clause written in Appendix A, page A14, paragraph 18.j., which describes "Buyback and Lease Termination Remedies?" Here's part of what it says:"...in the event that, during the 18 months or 18,000 miles (whichever comes first) following the completion of the Approved Emission Modification (the “Remedy Period”), Defendants fail to repair or remedy a confirmed failure or malfunction covered by the Extended Modification Warranty and associated with the Approved Emission Modification (a “Warrantable Failure”) after the Eligible Owner or Eligible Lessee physically presents the Eligible Vehicle to a Dealer for repair of the Warrantable Failure; and (1) the Warrantable Failure is unable to be remedied after making four separate service visits to the same Dealer for the same Warrantable Failure during the Remedy Period; or (2) the Eligible Vehicle with the Warrantable Failure is out-of- service due to the Warrantable Failure for a cumulative total of 30 days during the Remedy Period, not including any days when the Dealer returns or otherwise tenders the Eligible Vehicle to the customer while the Dealer awaits necessary parts and such vehicle remains Operable."

MB dealer has had my car for 13 days. They have no idea when they're going to get part. My vehicle remains in "limp mode." They could return it to me while we wait for part, but is a vehicle in "limp mode" considered "Operable?" At this rate, vehicle unlikely to be back to me within 30 days.

Anyone else in the same or similar boat? MB dealer said "lots of vehicles waiting for this part...

Appreciate anyone that can help with this one - it's getting into lawyer territory I believe...

You may want to call the firm that won the suit. I'd bet they will come up with the part within the 30 day timeframe.

I am in the same boat. Dealer has had the vehicle for a month. The part number is 642-140-21-60-64 and its not available. I had the emissions recall work done too earlier in 2021. This should be covered by MB for free but they don't have the parts. No word on when the parts will be available. It's terrible.

I had the same part fail in October. I got lucky and found one at MB Tampa. I just called them and they are now out and said it has been on back order for some time. Just read what you provided. Super informative - thank you! Just FYI - my dealer just informed me it will now be end of March for new EGR valve, so GL will have been sitting there for 3 months plus. Based on progress so far, I’m not optimistic that they’ll achieve end of March. I’m going to pursue vehicle buy back and see what happens.

I had my emissions recall work done in Jan 2022 on my 2013 ML350 Blutec. Now it's October 2022 and I got a CEL. Dealer tells me I need and EGR valve at a part cost of $595 and that, as others have said, none is available. They said to check back with them next year. They said it's ok to drive but I have my doubts about that.
I read the documentation about the recall and it seems the EGR valve should have been replaced then and should be under warranty. I do not see the part number 642-140-21-60-64 on the paperwork.
If 642-140-21-60-64 is the right part I found it at https://classicparts.mbusa.com/. They say they have it when I go through the order process. I'm calling the dealer tomorrow about it.

Are there any updates from anyone else on this thread?

FWIW, the EGR valve is specifically covered by the new AEM warranty on the GL and I can't believe it would be different for the ML with the same motor.
