Closing Tailgate Switch
I'm surprised that Mercedes makes you push and hold the tailgate switch the entire time till the tailgate is fully closed. You would expect it to close just like it it does when go to open it which all you have to do it pull the switch and it automatically opens.
Anyone else find this annoying... I'm hoping this is just my car so I can take it to service and have them look at it.

Our 2021 closes all the way by just pushing the button on the rear door. Hopefully there is something they can do to yours to make it do the same.

It's not "risk management," it's the ability to sell in diverse markets. That's also the reason why windows and sunroof reverse if they run into an obstruction. There are anti-pinch laws in a lot of countries that Mercedes sells into.
I think it's a good idea for car companies to make cars that are legal in their markets. But I don't think it's a New concept.

If you are saying the legal department is complying with European laws, then you're correct.

Compliance with applicable laws may add costs, but isn't normally a litigation hazard for manufacturers of anything. These things are all driven by the endless need to try to idiot proof everything. I'm not going to go in to a rant about people having some common sense or recognizing personal responsibility.

The tailgate is equipped with automatic object recognition with a reversing function. If we can close it with our key fob, how is that any different than being able to close it from the door switch by just a pulling on the switch. There are other SUVs here in the state that automatically closes the tailgate by the push of a button.
