Class action lawsuit against MB for water damage
Okay guys, I just received this in the mail yesterday:
If you own an S or CL from 2001-06, and have water damage from the reed valve in the air/water ducts you are entitled to reimbursement. This reimbursement is for the serviced A or B and any and all damages from the water damage to electrical and other components.
Call 1-877-695-7485 for more information. This is the law firm for Marsikyan Litigation Administration.
I know there have been several members here that have had water damage, and now is your time to collect compensation.
On a good note for me, I had no damage.
PM me for more info guys.
Good luck
Oops, me bad, someone already posted. Sorry guys but I did give the phone number.

Since the settlement was entered in late December '09 and was in California (though it applies nationally), it's likely most dealers haven't heard of it. You did the right thing contacting your dealer for billing data. The claim will be paid by MB (through the Claim Administrator) - but likely after deduction of attorney fees and costs.

If you read the links provided, the settlement relates to the reed valve, which is only in the front.
You need to have your wheel well checked for leaks - also the air vent behind your electronic equipment. It is a different issue.

I've heard some people are opting out of this class action law suite, due to the amount of money that will be rewarded to the attorneys. I had about $1,200 worth of damage due to the reed valve, received a copy of the work done from dealer and it was all out of pocket. even if you can get some money back who cares what the attorney are getting for their work? you will still get money you would have never gotten back had someone not started the class action. I have not yet sent in my paper work yet because I thought I would be able to call mbusa and try to settle getting the money back without entering into the class action, but they don't discuss any of the law suite and refer you to the 1888- number. I'm not an attorney am I missing something? do I send in the copy of the work order? I just don't understand why someone would opt out?.
Thanks

You have a good view of it, gac. I don't think the folks opting out understand either. What that does is give them the right to pursue their own suit - from the beginning and entirely separately - for any damages they might have. They would have to cover all the ground that has already been covered by folks who knew what they were doing in this case - the attorneys. They would bear all of the expenses of their own case - and those expenses are likely to far exceed any recovery. Once they look into it, they will elect not to proceed at all, and will lose any recovery.
It is true that folks who will benefit from the settlement will have attorney fees deducted from the total recovery - but what would they get if the attorneys had not done their jobs? MB didn't just come up with this settlement out of the kindness of its heart. Getting into a snit over the fact that the attorneys didn't do the case for free is shortsighted. My bet is that none of the MB owners works or provides services for free, either.

S Class & CLS 320 7G
Hi everyone, brand new to this forum so play nicely! LOL
I have a 2002 320CDI S Class. I'd just sold it after buying a CLS when it refused to start. Problem:- drowned CAN Ecu, blocked duct. The Main dealer is charging me £1211 to replace it.
Q Does anyone in the UK have experience getting MBUK to pay up for this repair?
