MBUSA Class Action Settlement for M272 M273 balance shaft issue

I received notice about a class action settlement related to the balance shaft issue with the Mercedes V6 (272) and V8 (273) engines with serial numbers up to 2739...30 088611. Here's a copy if you have not received one and own a 2007 S-Class with the issue. Even if you were a previous owner and you had to pay out of pocket, it looks like you would be entitled to reimbursement. All depends on the final approval of the settlement on August 17, 2015.

Thanks KNBS550.... I got my notice a few weeks ago, (I had the repair made under my aftermarket extended warranty), while the repair cost $2,800, I was not charged directly since my extended warranty covered it! My question is, since I bought the warranty which covered the repair, am I entitled to any compensation for my expense?

Hi 1st Benz, that's a good question. See attached PDF of reimbursement section and refer to item 4. on page 3 of the settlement notice on double recovery. It looks like the claim would be offset by any amount you received from the warranty coverage (Mercedes-Benz or 3rd Party) to cover the cost of the repair. I'm no lawyer, but you basically paid for the balance shaft repair indirectly via extended warranty and that amount would not be reimbursed.

Of course you could always file an objection to the proposed settlement before June 27, 2015, and state your situation. My experience with doing this in a past class action lawsuit with a financial services firm is that it doesn't matter. For this MBUSA lawsuit, the lawyers make out with $2.475M and the original plantiffs get their $3K, and $6K. We get a declining scale coverage on the engine problem up to 125,000 miles.

Can you still be repaid for this or is the settlement repayment date passed? I replaced balance shaft for timing chain, is this the same thing as included in the settlement? I have a 2006 E350 and the repair was done February 2013 at 73,000 miles. I appreciate any help guys!

Sounds like the part covered in the settlement.

I'm not a lawyer, but based on my read of the settlement terms, it appears that you missed the deadline to submit a claim. It was September 25, 2015.

'Any claim accruing prior to May 13,2015, must be made on or before September 25, 2015.'

If that's the case, that's unfortunate because based on when you got it repaired, at 73K miles, you may have gotten 70% of your money back.

'For balance shafts or idle gears needing replacement of the part(s) that are repaired and which repair date occurs up to and including the lesser of 8 years or 80,000 miles, MBUSA will cover 70% of the reasonable repair amount;'

You may want to try contacting the law firm handling this case?

If anyone followed this case from the start, it's pretty obvious Mercedes tossed their reputation in the trash on the issue.
