NHTSA said it is "closing this investigation based on the manufacturer's extend warranty of the affected fuel system components and in consideration that the nature of the leaks does not appear to present an unreasonable risk to motor vehicle safety."
Well....

poohlvhun 12-23-2014 01:10 PM

That's great news!

Moosepuck 12-23-2014 01:10 PM

damn, too bad I replaced mine already as well! I doubt they'll be giving anyone refunds though. Still, good news.

No way the legal team at MBZ is going to admit fault.

They are agreeing to pay for repairs, get your refund!

Okay, gotta find the letter that MB published and march into the dealer. Or better yet just call MB since most of us have record of visiting the stealer.

BC928 12-23-2014 01:13 PM

I'll take the cash if I can get it, but this part is stupid:

NHTSA said when the tank is full, fuel can slowly weep or seep from micro-cracks in these components and may collect in cavities on top of the filter/sender, pump, or tank. "Contrary to complainant's allegations that fuel entered the inside of their vehicle under the rear seat bench, neither (NHTSA) nor Mercedes found a plausible way for this to occur," NHTSA said. "The fuel tank is located outside of the passenger compartment, attached to the underside of the vehicle. The service access ports for the fuel filter/sender (driver's side) and fuel pump (passenger's side) are located under the rear seat bench, covered by a steel plate, sealed and bolted to the vehicle floor."
yes - when the fuel adds up on the top of the sender, it moves around and soaks INSIDE the car, under the "Steel plate" that is not sealed perfectly.

Here we go:

Letter explaining how stealers will deal with customers.

BC928 12-23-2014 01:27 PM

They explicitly proved somehow that the fuel does not wick past the plate. Strange, as it usually does.

CharlyE500 12-23-2014 01:34 PM

Great news ! good to know !

ParadiseLV 12-23-2014 01:48 PM

So can we have this work done without exclusion? Or do they need to inspect and determine there is a problem?

SilverStrk 12-23-2014 02:03 PM

I just did mine last week:eek: If anyone finds out how/when we can get re-imbursed please post it up... Otherwise Great news if they actually take care of this...

E55Vroom 12-23-2014 02:41 PM

when do you think that memo will make it to the dealership.

novae500 12-23-2014 03:03 PM

What about those that had to fix out of pocket prior to 12/23/14? Where does that leave us? Does this mean that during the 15 yrs, we can take it in for multiple repairs if it leaks again and again?

tolentino71 12-23-2014 03:39 PM

Fantastic news!!! And yes, are all dealerships aware of this memo?

Great question. I'm going to call my local dealer today to see how to go about even getting the work done.

SICAMG 12-23-2014 04:28 PM

As the world turns yet again with the Dealer. Just called my dealer and was told there is no such thing and they have never even heard a a fuel leak in these cars. Are you FUDGING kidding me? All the information I gave the manager was complete news to him and there is nothing he can do. Good Times !!!!

WANTED!! 12-23-2014 04:28 PM

According to the service department at a dealership an hour away from the dealer local to me, they say it's not in the system yet. Damn.

SICAMG 12-23-2014 04:38 PM

Thats fine but they never had a fuel leak in a W211 ? Really. And I heard this from two Dealers already.

berti_00 12-23-2014 04:59 PM

Sweet stuff I will mine into a shop soon

HeissRod 12-23-2014 05:12 PM

Now I want mine to leak so I can get new pumps instead of replacing them as a maintenance item.

2000UZJ 12-23-2014 05:13 PM

Sweet. My P0456 came up this morning. I've been battling fuming for months now. I can't fill up over a half tank. Gets pretty old having a limited range constantly.

Bigtickets 12-23-2014 05:22 PM

Haven't had this problem yet....knock on wood. But glad they are taking care of it. With all of the recalls going on with other manufacturers they probably figured that a lot of people have been complaining about smelling fuel and if one of these actually does ignite...
