2018 E63 Wagon LEMON LAW Issue need advice!
Hi guys,
I bought my wife a 2018 E63 wagon about 5 months ago. It's been in the shop several times, most recently it was in there for 40 days straight to replace the "cam adjusters".
The car would shake badly at idle. After 40 days of driving a loaner GLC300 we get it back and it's still shaking periodically. The lemon law here in Arizona says if a car is in the shop for more than 30 days total for the same thing in 3 years it's a lemon. Well our has been in about 50 days in the first three months with less than 1000 miles on it! So we contacted Mercedes about a buy back and they denied it because since we leased the vehicle state lemon laws do not apply. LOL. We contacted a couple lawyers and they said the same thing.
We have bought over 20 new Mercedes products overt the last 25 years and I even have a $200K 2019 GTR on order that is supposed to be here in two months. Who can I contact at MB to plead my case? At this point I'm stuck with nightmare car that they won't buy back. I feel like canceling on my GTR as I will be leasing that too and now know if it's a lemon Mercedes won't do anything for me. Any advice would be greatly appreciated. Thanks!

Obligatory I'm not a lawyer: my read of AZ's lemon laws is that they differentiate only between new and used vehicles, nothing excludes or explicitly mentions leases, which I'd have thought constituted new.
I'm thinking someone on this forum knows someone at MB HQ who can ease your way out of this pain.

Oy vey, what a mess. I can't believe a state would exclude lessees from a warranty. Maybe Magnusson Moss has something to say about this? What happened in Mago then? Perhaps OP can purchase his vehicle under the lease terms to make a bona fide lemon law case under AZ law?

and i imagine now, if they take your car back they will "fix it" and place it on sale as a CPO for the next sucker to buy it!!
@BenzGTR i would not order the GTR and canceled it right away. Go shop somewhere else. Buy a Porsche.
If my coming E63 S gives problems i will not buy any MB again in my life, that is for sure.

This is where a good dealer comes in . They can get you out of the lease and into a new car . I have seen it done many times on problem cars . Then it gives them time to figure out the issue and they dont have to loose a car due to it being declared a lemon and a good customer. Win/Win

a) Get a couple giant magnetic lemons made and stick them on that bad boy. Pay a guy to drive it back and forth in front of the dealer anytime they are open.
or
b) Paint it bright yellow, get all boozed up, and drive it through their front door.
Seriously though, personally I would cancel my order immediately. They have shown their hand when it comes to handling adversity. Why get in even deeper? They know you are faithful...prove them wrong.

Who owns the dealership? Part of the national chain of Awful Nation or others like them? Or private?
I would play nice and sit down with the owner or general manager with a spread sheet of just how much money you have spend at this dealership (stealership?) to make your point.
Also what is the penalty for breaking the lease? Might be worth the money to avoid the headaches.
And like what @tonecas said, go buy Porsches. Resale value on the GT3RS, GT2RS, etc series is insane. Nothing like the plummet that we see in Merc's.

LOL! We haven't talked to the dealer we got it from yet, only Mercedes headquarters, the letter we got the denial from is from "Mario Haro" "Customer Care Manager" "Mercedes USA", there's nothing really the dealer can do on their level.
The car was bought at Gilbert Mercedes here in Arizona, and my GTR is on order through Schumacher Mercedes which is owned by Penske. When I was talking to my salesman for the GTR about this I said if Mercedes didn't buy my car back I would cancel the GTR because how could I risk another lemon with the same motor etc and he replied "Ok I took your name off the car". LOL. I've bought at least 10 new cars through that dealership.

I’m really beginning to think this is the hold up on new vehicles with this engine being released. They know they have an issue, can’t figure it out, and are probably shaking in their boots. It was probably the same issue last year and they had to cave in and release them thinking the problem was resolved, or at least thinking they would resolve it shortly.
In all honesty...all these reports of lemons have me concerned. Especially with resell value when people Google and see tons of “CEL/Lemon” threads.

I think it’s either the European emissions standards certifications (post-VW scandal) or a purposeful sales/marketing strategy by Mercedes Benz worldwide (in conjunction with MBUSA) that’s releasing these models in stages. If it’s a coordinated sales/marketing strategy, I will say it’s definfiely a different experience than what I’ve had with BMW where they release models to the dealers as they clear the VPCs and aren’t held up en masse.
