Angry Engine replacement 2004 E320

New to the board here but have been viewing activitly for the past 6 months and well become somewhat of a daily routine to closing out the day. Well I finally activated an account and thought I would post.

Today visit number 12 to the local dealership after numerous problems with my car 2004 E320 loaded up with every problem ranging from the breaks to the command unit and now.............. the engine. Brought it to the dealer lastweek for a tapping noise when you give it some gas. They replaced the motor mounts and guess what .. the tapping noise continued. They call me tell me that a MB Tech from NJ will have to fly in and take a look at the car. Great right.. not really. He comes removes a few spark plugs and takes a look inside with a scope and surprise, metal shavings from who knows what..

He tells the shop tear it down and order a new engine. Now minded this is not an AMG nor is it a car that gets abused, this car gets about 60 miles a day on the highway and that's it. Not racing or any pushing the car to the red line and it only has 16k for miles on it.

I have read about all the problems, but I have yet to find or hear of anyone gettting a new engine due to potential mfg issues in Germany. So I keep telling them the car is a lemon, they keep putting new parts in the car.

I feel now with a new engine that my car is tarnished for life and never will be or run like a Mercedes E320 should. At a loss as to what I can do except suck it up and deal with it. Will I ever buy again.. sure is questionable with all these problems. My Infiniti has never been in the shop for any recalls nor problems and I have had two of them.

This happens on rare occassions and I am certain that Infinity has had some also. However, if the job is done correctly your car will not be tarnished and it should run as it was designed to. If this bothers you try to make a deal with them and have it replaced, maybe just pay for the miles you have used or some such program. My 05 E320 4M has been flawless since delivery to me last Feb.

A brand new engine on a car with ( assuming 60 miles a day) 25000 miles done by a professional shop? I think someone would buy your car first when picking between 2 with comparable miles. As for all the other problems, I hear you and shame on mercedes.

Twelve visits? Wow you're patient and more so than most states' lemon laws. You don't post your state residency but I would investigate a claim to return the car to the manufacturer.

Good luck with your car.

Sorry I didn't claify things a bit.. The twelve visits were for diffrent problems, all of which were fixed. The problem is they never seem to end, always something new. I live in NH so the law requres that it be in for 7 days straight without a fix for the same problem.

I tried to get a deal with a new vechicle but the numbers were still coming out 16k more than I care to spend.

My friend had an Accura RL? After 2 years and about 30K miles the engine blew. Twisted rods, you name it. Thedealer kept it for 1 week and dropped a brand new engine in that baby. That was almost 4 years and 200K miles ago. Still runs great. I'd take a new engine. Complain, perhaps you can get some other concessions like extended warranty for free.

Every car maker has it's problems... I can dig up posts on the Lexus boards and Toyota boards with the same issues. They make some 200,000 of the W211's per year... you're going to have a few bad ones.

The good news is they're giving you a BRAND NEW Engine? Not one pulled from a junked car? That's worth at least $10,000...

I would take the engine and run! Also, I would INSIST that I watch them install it to make sure there isn't any shoddy work being done. YES, you'll need to take a couple of days off for that.. but it's worth it.

Quit bashing Lexus, damn it!!!!

Take the new engine, run with it. Demand a 100K mile warranty for the new engine, since you've lost faith in them. Get an extended warranty on the rest of the car too. They'll give it to you if you ask nicely.

When I bought the car I purchased the 100k mile warranty with it.. Knowing all the problems they had in 2003 I wasn't going to take the chance. Perhaps I will ask for a Satellite radio install since it is the only option oo the command I'm missing. They started to tear it down yesterday and I am off to NJ for a few days so I will have to trust in the MB techs to do the job right. Don't really think they want to see me coming back much longer..

Ask for a couple of hot blondes.

Sounds like a plan with the sat radio request. Do let us know what their faces look like when you drop that in their lap. Do it while calmly sipping a latte so if they start laughing, you can accidentally spill the latte on their desk.

I agree, ask for the world, all they can do is say no. Get Sirrus, ipod, and DVD NAV if you already don't have it. And two hot blonds as well...

I haven't seen that requirement, but in New Hamshire, a vehicle is considered to be a "lemon" if:

the new vehicle is substantially impaired in use, value, or safety due to a defect covered by the manufacturer’s warranty that the manufacturer or its authorized representative has not fixed.

In order to qualify for arbitration, a consumer must ordinarily show either:

1. the manufacturer or its representative has made at least three unsuccessful attempts to fix the motor vehicle; or

2. the motor vehicle has been out of service for 30 or more business days (cumulative) due to defects or nonconformities covered by the warranty. NOTE: In some cases involving extensive or dangerous defects, the hearing board may decide to hear a case with fewer repair attempts or days out of service.

I don't know your service details, but I would assume you qualify. It's up to you to decide whether a new engine or new car better meets your needs.

For more information: http://www.nh.gov/safety/dmv/lemonlaw/answers.html

Good luck with the repairs/replacement.

You all have my interest with relivent to the Lemon laws. I did check them out in NH and certainly fit the critaria. I think my problem would be is that I bought the car used with 10k on it for mileage and it has every option from NAV to Dynamic seating and I really do like the car. Could I assume that Mercedes could actually give me a brand new vechicle with all the bells and whistles this one has or would they more than likely just refund what I payed for it.

If it was just a refund then I would probraly opt not to give it back to them since building out a new one is beyond my reach..

Used vs New

Because lemon laws probably don't apply to used cars.

From the link posted above:

Q. ARE USED VEHICLES COVERED UNDER THE LEMON LAW?
A. Yes, if the defect and the 3 repair attempts and/or 30 business days out of service occurred within the manufacturer's express warranty period.

Went and visted the car today and 1 week later no engine still.. Lots of pieces from the old one, vented off to the saleperson and didn't get to far although he did offer me a 2005 ML500 pretty much loaded up as much as a ML can be + an additional 3k in cash. The car is a 2005 with 14 miles on it and I suspect they are trying to clear the lots with the arrival of the 2006.

No exactly what I was looking for but certainly something I guess I could think about.

I feel your pain. My car was in the shop for 12 weeks give or take 1 for multiple engine issues and the end result was the TCU and in the end made the tranny fail on my 05 E500 with 6800 miles on it. I have lemoned the car and am working on getting a new one. Love the car and understand every once and a while you get a bad one. So I am sad to see it go especially since Scorchie lowered it and I added a nice set of 19's and tint. The 19's are staying with me and hopefully will be going on another 211.

Good luck
