Engine replacement 2004 E320
Today visit number 12 to the local dealership after numerous problems with my car 2004 E320 loaded up with every problem ranging from the breaks to the command unit and now.............. the engine. Brought it to the dealer lastweek for a tapping noise when you give it some gas. They replaced the motor mounts and guess what .. the tapping noise continued. They call me tell me that a MB Tech from NJ will have to fly in and take a look at the car. Great right.. not really. He comes removes a few spark plugs and takes a look inside with a scope and surprise, metal shavings from who knows what..
He tells the shop tear it down and order a new engine. Now minded this is not an AMG nor is it a car that gets abused, this car gets about 60 miles a day on the highway and that's it. Not racing or any pushing the car to the red line and it only has 16k for miles on it.
I have read about all the problems, but I have yet to find or hear of anyone gettting a new engine due to potential mfg issues in Germany. So I keep telling them the car is a lemon, they keep putting new parts in the car.
I feel now with a new engine that my car is tarnished for life and never will be or run like a Mercedes E320 should. At a loss as to what I can do except suck it up and deal with it. Will I ever buy again.. sure is questionable with all these problems. My Infiniti has never been in the shop for any recalls nor problems and I have had two of them.

I tried to get a deal with a new vechicle but the numbers were still coming out 16k more than I care to spend.
The good news is they're giving you a BRAND NEW Engine? Not one pulled from a junked car? That's worth at least $10,000...
I would take the engine and run! Also, I would INSIST that I watch them install it to make sure there isn't any shoddy work being done. YES, you'll need to take a couple of days off for that.. but it's worth it.

Take the new engine, run with it. Demand a 100K mile warranty for the new engine, since you've lost faith in them. Get an extended warranty on the rest of the car too. They'll give it to you if you ask nicely.

I haven't seen that requirement, but in New Hamshire, a vehicle is considered to be a "lemon" if:
the new vehicle is substantially impaired in use, value, or safety due to a defect covered by the manufacturer’s warranty that the manufacturer or its authorized representative has not fixed.
In order to qualify for arbitration, a consumer must ordinarily show either:
1. the manufacturer or its representative has made at least three unsuccessful attempts to fix the motor vehicle; or
2. the motor vehicle has been out of service for 30 or more business days (cumulative) due to defects or nonconformities covered by the warranty. NOTE: In some cases involving extensive or dangerous defects, the hearing board may decide to hear a case with fewer repair attempts or days out of service.
I don't know your service details, but I would assume you qualify. It's up to you to decide whether a new engine or new car better meets your needs.

If it was just a refund then I would probraly opt not to give it back to them since building out a new one is beyond my reach..

This exact same situation happened to my ML500, they replaced the motor mounts TWICE, the command unit TWICE, sparkplugs TWICE, Transmission mount TWICE, i'm still bit**ing at them and they ignoring me and everything! so angry! i hate MB-Manhattan
