IF the manifold is really warped, replacing the flap lever won't fix it. But how does the shop know the manifold is warped?
When I had my 2007 E63 in for a CEL, the shop was also "guessing" that the problem was a warped manifold. They were quoting $3000 for that manifold. Turns out one of the vacuum fittings on the manifold were loose. Simple fix.
Couple of things to try. Check for vacuum leaks, all hoses connected and in good shape. Use starting fluid while the engine is running and spray a small amount around suspect areas. If the idle changes, you found a leak.
Since you have to take off the manifold to fix the flap lever, you can easily check it for flatness. New gaskets may be all that is required.

Warped manifold on the 221 v8 cars is usually a sign of previous severe overheating conditions. They do go if cooling breaks down and driver is oblivious to the failure and ignores the myriad of warnings

How ironic; warranty company refuses to fix thermostat saying its within spec.
