President Bush Expected to Sign Bill to Ban Vicarious Liability

On Friday, July 29th, 2005, the House and Senate of the United States voted out the Highway Bill (HR3). This bill contained section 30106, entitled Rented or Leased Motor Vehicle Safety and Responsibility.
This section states "An owner of a motor vehicle that rents or leases the vehicle to a person (..) shall not be liable under the law of ANY State.... By reason of being the owner of the vehicle for harm to persons or property that results or arises out of the use, operation, or possession of the vehicle during the period of the rental or lease."
What that means is .... Lessor Vicarious Liability no longer exists.
The bill is expected to be signed by President Bush before the end of next week, and becomes law upon his signature..
This is GREAT NEWS for those who want better/competitive leasing options in the states of CT, RI and NY.

The sad part is a law/bill has to be signed for one of the most basic things in life - personal responsibility.If you drove the car then you should be responsible for your own actions.Hopefully this will eliminate so of the non-sense lawsuits created by the paid beggers ( lawyers).

What if a person rents a badly maintained car, from a rent-a-car, and then, while driving, causes an accident due to something going wrong with the faulty car, is it going to be the drivers responsibility to pay for the damages or the rent-a-car company's?
My colleauge just leased a 50K Acura TL and his wife was driving around 20 mph in his neighbourhood and the front axle came off and made her hit someone's mailbox and messed up the landscaping. The damage was around 20K which Acura eventually paid for. I wonder if the new laws would prevent Acura from paying if this would have happened after the signing of the bill.

That is different, in the case you state then the rental car company would be at fault for not doing proper maintenance.
