Got Red "lite" Ticket Violation

Yeah, that is how the cop spelled it. Anyway, I was going home from school and needed to take a right turn. The light was red so I slowed down to a stop. But I then pulled a little forward to see if it was clear to make a right. This was in a residential place right by school, so one could imagine that it can be full of cars parked by the curb and what not. I saw that it was clear so I turned right. 2 seconds later, I hear the siren and saw the cop right on my a**. So I pulled over by an elementary school and cop told me that I ran the red "lite." I tried explaining to him but he said I didn't stop. He told me the 3 options I had, and that winning in court was "slim to none," unless he doesn't show up. This was my first ticket and I am scheduled to appear in court in April, because I do not want to pay ~$300. He also drew that I was turning left on the little diagram on the ticket. I WAS TURNING RIGHT! But yeah, any suggestions? So, far I took pictures of the area and will draw a diagram. By the way, I live in San Jose, CA. HELP please?

Your chances of winning outright, proving the cop wrong, are slim to non, plead down the ticket to a non-moving violation and pay the extra fines. Sometimes you can speak to the prosecuitor, the cop putting incorrect information on the ticket helps you. Otherwise a lawyer will help. But you will at least need to appear in court to plead not guilty, or have a lawyer enter a not guilty plead for you.

I got a reckless driving ticket in CT for doing 97.2 in a 40mph zone. SUX. best of luck to both of us. The goal is to plead the ticket down, pay the fines, avoid points or revocation.

Thanks for the input so far. The option I picked when I went to schedule my court appearance was that I didn't have to pay now, and if I win I don't have to pay at all. But the risk is that if I don't win I have to pay and I THINK 1 point off for 2 years. Keep the replies coming .

did u or did u not stop? sounds like u have case to being the cop being ****. the thing is... if u had really saw that it was clear, then u would've seen the cop yeah? just trying to let u know...

That is the thing. I didn't see any cars coming. I mean why would I try to cause an accident or something, let alone a COP, and go through all this? From the time it was clear. But it was pretty hard trying to look at the road to the left for oncoming traffic. The road I was on slightly goes uhphill and also leans to the right, where I was. There were cars parked from about 8-10 feet from the corner together with shrubs and trees. With that in mind, it was difficult to see. I stopped. Then, I pulled up to see if it was clear, and I turned, I look behind and I the cop. If you ask me, I think the cop was speeding, but that doesn't really help, I think. I hope you get my point . I mean it is all common sense, right?

If its your first ticket you sould be able to get the fine dropped to a few dollars plus court cost. More importantly you want to talk to the D.A. about dropping your points. Its worth paying the whole fine if they drop the points.

My 1st ticket was last year(within 6 month period of getting license). I was on the Southern State Highway here in NY doin' 77mph(in a 55mph) in my 1977 Mercedes Benz 300D(car only has 77hp). So, there was no way I was getting out of it. I pleaded guilty and paid $150 fine and I now have a restricted license(only allowed to goto school and work). So, if I get caught again now my license is taken away for 2 years. Than in November 2002 I got caught doin' 85mph in a 50mph zone in my MB 230K. I pleaded down and paid $250 fine. Which came out to $280 due to $30 surcharge us NYers have to pay cause we're in debt. 9/11 debt.

Got caught twise too....doing 57 in a 30 that cost $90.....and 82 on the LIE....that cost $180, but that was in my il fated BMW thought.... being a good boy in my C-class....
