thanks for everyone's input. i just wanted to make sure the problem was the same from the last time i went to the dealership. they said it was the upshift delay valve. he said no biggie, but i need it fixed before i get a smog. supposedly this thingy keeps in gear longer when the car is still cold to help it warm up.

called the dealership and not too bad. $169 for the part and one hour of labor. so if i use up the gas from my loaner, we can call it even.

If it is the valve at fault the repair isn't too bad. In my case it is the cable itself so the repair will be pushing $1K. Needless to say I'm not fixing it. I "trick" the computer on every startup by starting off "spiritedly" each morning so the rpms go above 3K rpm for the first shift. It helps that I have to go up a hill each day but in anycase it keeps the CE light off.
