can you sue your mechanic if they damage your car?

If you take your car in for repairs and they scratch up your car in the process or break something, can you sue them? how would you prove that they did the damage?

Are you taking your car to a MB dealer for repair? If yes, the proper way for them to do is to inspect your car for any physical scratches or dents, etc when you take it in. If your car ended up being damaged, they should be responsible for it. Too bad for them if they didnt inspect it.
But if you just bring your car to the mechanic down the block, I dont think you can do anything about it.
In either case, there's nothing that you can prove the damage though!!

I would say that the answer to you question is yes (I'm not a lawyer). It seems like you can pretty much sue anyone for any reason. The question would be if you had enough proof that the mechanic was negligent and caused the damages. I would imagine you would have to have witnesses saying that the car was not damaged when you took it in, or something like that.

No. Pursuant to the Federal Automobile Technician Immunity Act (28 U.S.C. section 1454, et seq.), you automatically release all auto mechanics from any liability for anything they do to your car. Sorry.

Most dealer service departments and mechanics require you to sign a contract authorizing them to do work on your car. Buried in the fine print is some verbage releasing them from liability if your car is damaged. If you could prove gross negligence or willful misconduct that would be another story.

i've always had some luck when my car was slightly scratched. they accepted the fault.. after about an hour of arguing and threatening to take legal action....
