Buy out

My dealer gave me an offer today to buy out my 01 C320 and replace it with a 03 C320. I have had a lot of problems with my car, and threatened them with the lemon law. I would have to pay around $4000 for this swap (they said $5000, but will talk to MB to reduce it to $4000, so I don't know yet). Maybe it's worth paying $4000 to get a two year newer car? In a hope that this one will be of better quality. I guess they also corrected many problems in the 03 model. I could of course try to go ahead with the lemon law, but I feel I'm in a weak position, as my car had many, many small problems rather than one big problem. On the other hand, I could keep my current car and hope they have finally fixed all problems. It seems to be relatively OK now, although there are still lots of rattles and squeaks from everywhere. But so far things have regularly broken down. I think $4000 is in the range of what others have been offered. Or are they ripping me off?

$4K to upgrade 2 model years! ... your car has depreciated 2-3x as much as that, take the deal unless the 2003 doesn't have as many options as your 2001.

i think it is a fair deal. especially since you have a 1st year car and hopefully, a lot of the little problems have been worked out. but did you like the car enough to get it again?

Lemon law time limits may have expired for you and you may have to pay pro-rated mileage anyway that exceed the 4k. So if it was me I would take it, no questions asked. Maybe they'll give you a brand new 2002 for a lesser difference.

Sounds fair and very similar to what Audi offered me. After all, you did get some unimpaired use out of it and that's worth something. Like Buellwinkle said - it certainly beats depreciation. Take it, get the '03 and enjoy!

Take the deal. You could always sell the new car privately if you don't like it. The depreciation on your 2001 is worth more than the difference you are paying.

Thanks for the advice. I will probably take the deal -- if the final offer from MB turns out as they promissed. My wife and I do like this car except for the problems. We thought about it, and we do prefer it to the competition. Anyway, if we sold the car and bought another car, the loss in value would be much larger.
