Rant!
In early October, I received a letter from MB TeleAide about the renewal of my subscription. At that time, I sent a billing change as a reply, because I was closing the account they used to charge. I gave them all the new account information, and thought we were good to go for the C and the E.
Well, as it turns out, they charged both the old AND the new accounts for both cars!!
The bank with the closed account now has had me served with a subpoena for mail fraud, ie: applying charges against a closed account! Mercedes Benz North America TeleAide customer service would not acknowledge their error, and would only promise a refund to the closed account within 10 business days after they complete their investigation.
THEY WOULDN'T EVEN OFFER A LETTER OF EXPLANATION TO THE BANK TO GET THE CRIMINAL CHARGES DROPPED!
I'll see my pitbull...er...attorney tomorrow at a Superbowl party and have him handle the rest of it.

you'll find this isn't the first time this occured.
Of course, I had to make the payment to the first bank, as they deducted the overdraft fee from the reimbursement, but at least that's settled.
My attorney has expunged the criminal charges in lieu of this action, but we are still on the fence about filing civil action in this incident. I want to let it go...he wants to go for the throat (does it matter that he drives a BMW?).

I say sue em. At least to cover the legal fees, and DEMAND a written apology for the screw up.
How much did you pay for your attorney? You should make MB pay for that too.
LOL....he still thinks we have a case for a civil suit to recover what he calls 'punitive damage from the criminal charges'....but I'd rather just let it go. Hell, the BANK should be the target of that suit for filing criminal charges without investigating the matter (and, yes..there were many other reasons I stopped using this bank...).

If you knew they did it on purpose or something, then you have a case...it was a mistake, thats it.
