First, the stock intakes are inhaling air from outside the engine compartment ahead of the radiator at the top which is as cold as it's going to get.
Second, moving the intake down to the bottom is a BAD idea because splashed water could be sucked in much more readily and when water gets into the engine, it's all over. Further, down close to the road is where most of the flying rocks and sand are so the engine air filters will need replacement MUCH sooner.
It's been pointed out before that installing cone filters inside the engine compartment guarantees that the engine will be inhaling hot air all the time since it's been through the radiator and AC condensor.

I will be working on an intake system for this platform in the very near future. Regardless of the design we decide to go with dyno numbers and videos will be posted so you guys can see the real gains for yourself
Stay tuned!

white and whiter
almost all BMW has a secondary air inlet down on the bumper. The airbox design has a drain for the heavy rain. of course, if you drive it into deep puddle you are an idiot.

You might not have been around but about a year and a half ago, many of us had heavy rains that flooded some intersections just enough to stay out of the passenger compartment. That's when we found out that it doesn't take much flooding to get into the engine and ruin it.
