Suspension toggle missing?

My dad signed a lease for a 2010 C250 4M w/ sport and premium package. (This might be a Canada-only model, i'm not sure)

He told me that during the test drive, the salesman told him that the car had a button to switch between sport and comfort suspension modes, next to the gearstick:

After using the car for a while, he found that the two purported "suspension modes" weren't different at all. Flipping through the brochure I found out that the salesman was mistaken, and that that button only changes the way the car shifts. The button my dad needs only comes on the higher models:

Had my dad known this, he would have opted to get the C300 instead of the C250. The ability to switch between suspensions was something that swayed him away from buying the Lexus IS and towards the Mercedes.

What are my dad's options here? Is it too late since he already signed the lease?

Well there's no doubt you'll need to pay more, including a fine for cancelling the lease early, but seeing as you're willing to upgrade to a C300, I'm sure the dealers would be glad to help you since you're paying an extra premium. I'd ask your dealer.

is a C250 a turbo charged 1.8L ?? then u probably want a C300, no replacement for displacement :P
My C230 2.5L has that option, but if you looking to lower your car or do anything to the suspension in the future, you probably dont want it, I just got myself eibach springs and i probably have to stick with original shocks for the rest of the car's life, but its always fun to know you have the option to go soft or hard :P the ride change is significant

Actually, I'd try to be a bit more aggressive than that. Working with the Sales Manager, I'd come in stating the expectation that you want to move into the C300 with the feature the salesperson mis-stated. Tell them you want a "substitution of capital" based on being mis-led. Of course, the salesperson will deny and indicate your dad misunderstood, unless you can surprise him by asking him to explain how the feature works again in the presence of the Sales Manager....could be he repeats the error if he wasn't well trained on the product.

The reason I would take this approach is that there may be various internal programs for entering vehicles in demo service, rewards for volume, or other mechanisms which may allow the Sales Manager to make this easier. I would not offer to pay an early termination penalty. If the Sales Manager is resistant, I'd even take it to MBC before giving in to a typical process. Certainly, most SMs will see this somehow as an opportunity to move another unit.

One last thought.....Eibach antisway bars provide a great compromise of significantly improving the handling, while not noticeably deteriorating the ride they way stiffer/lower springs do. It doesn't provide the continuous choice, but it creates an excellent overall chassis balance, probably better than either of the OE "choices".

The adjustable suspension comes in the Advanced Agility Package and if a salesman sold you a car that he said had this option and it didn't, I'd go to the sales manager and straighten this out. Make sure you are knowledgeable and reference the missing package though.
