Headlights shutting off

I have an issue with my headlights shutting off while driving. I have always turned my lights on manually as I like to run my fogs/driving lights most of the time.
If I use auto mode, I never have a problem. If I turn the lights on with no driving lights, they sometimes shut off. If I turn the driving lights on, they almost always shut off. Only the actual low beams themselves turn off and all the interior and marker lights, and even the driving lights themselves stay lit.
I am assuming they will just need to pop my light module out and replace. If this is the case, should I request the newer, simplified design that came in the 2010-2011 model? It seems like the new design should work on an older car but I am not sure if this is the case and if MB will even offer an "indirect" swap unless they were out of the old units.
Are there any benefits to moving to the new switch (form or function) such as it being lighted, easier to use, etc?

I have the same problem on mine a few months ago. The lights would turn on as usual and then shut off automatically at random times. Brought it into the dealer for Service A and they replaced the switch for me at no cost.
