Is it just the 2008 4matic that's having transmission issues?
From what I've been able to gather from doing research on the topic, the problem seems to stem from bad bearings that fail prematurely in the transfer case and it is completely unrelated to the transmission service and mileage driven. Basically: if your transmission has the bad bearings they will eventually fail.
While I'm sure it's no comfort to those of us affected the majority of these transmissions do not have bad bearings and will not fail in this way. The 4matic transmission is very popular and Mercedes sells a lot of them so if it were a flaw in the design reports of this problem would be far more frequent and widespread.
That said it's obvious that it is still happening to enough people that we see posts crop up on forums like MB World and Mercedes is likely aware of the problem. I would suggest that if it happens to your car while it is out of warranty it would be worthwhile to try and get some sort of satisfaction through your dealer and/or the Mercedes head office in your country (Mercedes USA, Mercedes Canada, etc.).
