1st, some background info:
1. I removed the resonator from the exhaust. Like many, I wanted to change the note and get a nicer sound.
2. I did a tune by OE tuning.
3. About a year ago I had the battery replaced.
Since the battery replacement, I've put 6,000 or 7,000 miles on it riding around town. Very small amounts of highway driving.
In California, you registration is not valid and not renewed until the car passes the smog test. The renewal notice made it seem, I'm registered but the documentation is held. So I thought I'll just drive it for a bunch of months. I figured if I get pulled over, they'll just cite for tags. I was mistaken. Now I'm in a rock and hard place.
I spoke to the dealer but they said it needs to be driven. They had one customer that took 300 miles before the readiness indicators self corrected. I'm going to have them check the battery.

OE Tuning responded We do not disable any readiness monitors or affect smog. I advise getting your car looked at by a trained MB tech.

UPDATE 3:
Evidently there is an issue withy the resonance flap on the manifold. The dealership wants to replace it to the tune of roughly $2,400.
Q1. Has anyone dealt with this? Q.2 Is there something on the manifold that gets dirty and can be cleaned?

Update 4: Even if the "Intake Manifold Lever" is replaced does not mean that your out of the woods. There can still be an interior failure. Once the lever cracks it put strain on the other parts.
