Need your input to build an argument
My new CLS will be there in a week and I'll be returning my C63 as the lease is expiring. MB is now giving me a hard time because my rear tires are Pzeros 265 and not 255 as the original specs. The worst is that the rear tires are brand new. Because I have the wear and tear protection, they suggest that I find a pair of bald 255 to comply with the requirements. What's this none sense! If I had P255 that were completely done, it would be fine and they would replace the tires. With my P265, they could also replace the tires if they don't like them or keep them as is i.e same cost for them or less. In other words, they prefer bald P255 to new P265...just crazy.
I certainly intend to fight it but I would appreciate your input on what other argument I could bring.
Given their views on a minor change to tires specs, I'm getting my ECU reflashed to factory settings before returning my car so they don't charge me for a new engine...

Lease return inspections are done almost always but 3rd party vendors... they are just going exactly by the book and will advise MBFS what should and should not be there.
The key here is the dealer- they have strong relationship with MBFS as that is probably their primary leasing bank and maybe even their flooring agent. It takes a simple call from the GM or General Sales Manager to MBFS and they will contact remarketing and get this small and inconsequential technicality waived.
The car will most like go to a highline lease return auction and the tire depth is more of a concern that 10mm in width.

Thanks. I passed by my dealership today. They're saying that this an insurance that MB is taking so that's why they're not flexible and that the terms of this insurance are about specs, not make, so it can be any brand in any condition as long as it is 255/35/18 94Y. I have to say that my sales guy has been pretty good so far in terms of info accuracy and he's trying hard to find a solution but the more I learn the less it seems to make sense...I may have to apply the solution suggested by Justthebest
