i'm so pissed

i was driving home from work tonight, and out of no where one of those stupid *** orange and white construction barrels came rolling into my lane on the highway. i guess the dumb **** that set them up forgot to weigh a few down. it cracked my bumper, scratched the **** out of it, and left scuff marks and dents all the way down the left side of the car. so what are my options? get the state to pay for it, sue the state, or file it under comprehensive on my insurance? i'm afraid to file it because i hit a deer a few months ago and although neither of these 2 things were my fault i'm worried that they may drop me. any advise?

If you go after the state you won't get a dime. But if you you after the general contractor then you stand a real good chance. You should go see them tommorrow on your way back to work.

contact ur georgia department of transportation, file a claim, they will probably send u to the contractor..

I you have full coverage like my crazee self I would go after someone whom would be responsible for placement of the item.
My Dad's insurance Co. went after NYC transit while fixing his car once and I had my insurnace Co. go after Verizon after one of their trucks had damaged my Talon when it was parked.

File a claim with the state, and I think they'll transfer you to the contractor, which should pay for all the damage done.

i agree with filing a claim with the state. i used to work in the massachusetts superior courthouse during law school, and we would see claims come in left and right for pot hole damage. it wasnt a quick process, though, to be honest.

as for your insurance dropping you, i have had a few incidents that were not my fault (hit and runs, etc), and i asked geico about it. they said that when its not your fault, it doesnt effect your rates "as much". in retrospect, my rates havent gone up at all.
