It is not fraud in any U.S. jurisdiction to modify ones property but if one represents it has not been modified to obtain warranty repairs causally connected to it, it could be fraud in some, but not all jurisdictions. In all jurisdictions, it is subject to restitution claims in a civil action.

This is not true. I dunno about the old ones but the new ME does not track mileage. Mileage is kept track of by a separate control module that is powered by the auxilary battery.
They probably removed it for the starter fuse recall. They just had to remove the ECU for it. No one opened the ECU housing and no seal was broken, that I can bet my life on. Also every single update I ever did was done through the OBD II port, I saw the tech do it myself, so I have no idea where heard this from that that MB has to open the ECU to update it.

I don't recall every affirmatively stating that they opened the unit and no one ever told me this, I assumed that is what they had to do to update it, what I said was the unit looked like it was removed- the dealer stated to me that it was a download- BTW I am taking car to dealer again tomorrow for the Adaptive braking error message and 3 more recalls- This car has had at least 7 recalls so far. The service guy on the phone told me it needed a fuel system software update-
Yeah just removing the ECU has no basis of voiding your warranty. There is no case for that. The way they realize that the ECU was opened is by looking for bents or markings on the backplate of the ECU cover. If you open it, it will 100 percent leave a mark. Then basically that confirms their suspicion and off goes your logs.

I am hoping it will give me a 50hp upgrade over the stock system
I will post when I pick up my whip later on today-
yes this time the Adaptive Braking **** the bed and they had 3 more recalls to fix, something in the steering column. So that is about 7 re-calls so far, not bad MB and my car has less than 10k km- this is a first.
