That is a real pain, I am sorry. I have had issues with my exhaust and had both mufflers replaced but t seemed to fix the issue I was having. I would continue to bring it back, and rack up the service time, because while I am not fully in the know about the lemon law, if it continues that will help you get rid of the sub par car.

I thought PE is only a sound thing. So it actually increases the 0-60 performance?

It does by a miniscule amount, like 1 or 2 hp.

I am going to guess that OP's problem is that the ECU is limiting power because of the error or that the blocked valve heavily restricts flow.
