Crackhead w/o insurance hit my car

Yep - happened in a parking lot yesterday. Dude just backed right into me and tried to flee. Luckily, I had witnesses so he stopped down the road a little ways.

Bringing her in this morning...hoping it's all cosmetic

Dang, sorry to hear. That doesn't look too bad. Make sure you take it to a good shop of your choosing. You have the right to select whatever repair facility you want.

So what is your recourse if the crakchead didn't have coverage? I assume your ins. will just take care of it and go after the crackhead?

Agreed. If you have full coverage, most policies include an uninsured motorist provision where your own insurance will cover the repair costs (and many policies state that it will not result in an increase in your premium). Additionally, if you are in CA, you have the right to send it to any repair shop of your choosing (perhaps applies in other states as well).

Yep - I have full coverage since I lease. I am only responsible for my deductible and they did advise they would go after the crack head since he is at fault.

I was able to select my repair shop also. Luckily it appears to be all cosmetic. I actually drove the car back home since it will take 2-3 days for the part to be shipped so I figured I may as well still drive her and not worry about renting a car.

I have State Farm and just went through this. I have a $500 collision deductible, but under the uninsured motorist coverage my deductible was zero somehow. My car was totaled, though. Ask your carrier what your deductible is for uninsured motorist because it may not be anything!

Additionally, if your insurance makes you pay a deductible, ask your carrier what happens under subrogation (i.e. your right to repayment in the event insurance collects from the motorist at fault).

I have State Farm also...I guess I don't carry the uninsured motorist coverage. The claims guy didn't mention this yesterday. Neither did my agent when I initially called

They already told me they would refund me whatever they collect...although I doubt they will get anything from this dude...

Thanks man. He was driving a 2005 Chevy Avalanche. And for the record, I'm calling this guy a crackhead b/c he literally had missing teeth and appeared to be high on speed. I also attempted to file a police report since I had all his info and 2 witnesses but apparently PHX PD will not file if an accident occurs in a private parking lot....

get "uninsured motorist coverage option" even if you have full coverage. It's premium and deductible are very low. I don't have full coverage so I am just taking the risk and instead of full coverage get this small option on top of my liability.

Personally, I think it's imperative to have maximum coverage, if anything too much coverage even. One crackhead having a bad day and you're done. Plus if a crackhead sees the Mercedes logo he might think free ride.
