Mercedes Benz Financial Lien Release Letter Help

Hi, I'm new to the forum and I need help from anyone here that has dealt with Mercedes Benz Financial. I bought a 2009 C63 that previously had a lien on it. The seller provided me with a MB Financial lien release letter but its been almost 2 months and I haven't received my title in the mail. I tried calling MB Financial regarding the situation but they said they can't release information regarding this matter because the lien was in the sellers name. I tried to contact the previous seller but his phone is off. Somehow I have a feeling this letter that was given to me by the seller is a forged document. Can someone be kind enough to post up a scanned copy of what a MB Financial lien release letter looks like.

I would contact MB Financial and try to get a sample letter of their lein release, as most people who receive this letter won't keep it after they receive the title

Also, if you know the Seller's full name and previous address, you can easily find his new phone number and possibly even new address

You don't list where your location is(?) But in some places it can take up to 90 days to get a title.

A lein relese must be noterized, at least here in Cali.. You should never by a car without a pinks slip and even then it could be salvaged even if the pink doesnt say so.. PM me the Vin and I'll see what I can find out. I deal with vehicle registration daily..

I did try to ask MB Financial to get a sample letter but they said they don't have any sample letters. I went to the seller registered address but the people that lives there now are new tenants.

I'm trying to make sure the letter is a forged document before going to the cops. Even then I doubt the cops will do anything coz its going to be a civil matter.

First, MB by law cant release info, because without a title transfer, it is still in sellers name. They can't tell you even if it is paid off or not.

Now, if you have a copy of a lien release letter, and it turns out to be forged, you can definitely file a civil claim for damages, and press charges...that is a serious crime, and yes, that should be notarized.

Finally, I've been waiting 3 mos from California to get my title on an Altima I sold a while ago...they are SLOW, and have no way to speed up except in person, which I don't live there any more...

you are correct, cops will do diddly squat for you. They will tell you its a civil matter.
i had this situation when I bought one of my cars... I was on the hook for $75K and seller was not sending title or paying off lien with financing company.
Finally he did and I got the title though...

They wont do anything but fill out a report on the fraud if there is one. Its good to have a report with the police if you think its a criminal matter.

If he indeed IS trying to scam you or you feel that you have been scammed file a report with te police. Also run the VIN to make sure the vehicle is clean and not stolen.

The only advise i would give is keep a eye on the car if the document is forged and he ran with the money and isnt paying the payment its a matter of time before a not so friendly tow truck might come looking for that car

Have you tried calling your local tax or registration office? They should be able to run the VIN and see what the status of the title is.

Hopefully this all works out for you. But I agree with a previous poster who said keep a close eye on your car. Do you have all the keys?

No, it is not a civil matter, document forgery is a criminal offense and in addition to forgery it is fraud and it is probably a federal offense since he involved the US postal service with the letter and most likely an interstate crime depending on where he, you, and MB financial reside. Another reason you need to get the cops involved is to make sure you are not driving a stolen car, you don't want to find out the hard way the car is stolen. It could be a "tagger" it is very easy to create multiple conterfit VIN plates with the VIN of a legal vehicle and attach them to a bunch of stolen cars, by the time you catch up with the crook he is long gone. A friend of mine got scammed on a motorcycle that way...end up the theifs had one legal bike with a title and sold 5 stolen bikes with the same VIN in a short period of time, by the time the people and DOT figured out that 5 people were trying to register the same vehicle/title it was too late the theifs were long gone and moved onto their next scam.

Good Luck
