While the code itself can be encrypted, that just prevents the ability to modify on the fly, or access the code itself. There is nothing preventing entirely new code from being flashed over the existing code or erasing the existing code..

Guys, ive been getting killed with work lately. I have not gotten much done on finding and fixing this problem yet. I did get the ecu flashed back to stock but I havent gotten a diagnostic yet. Ill probably do that next week. Ill let you know how it goes when i can find some time.

even though i sold the car I did get the problem fixed. the problem was.....drum roll please........it was low on transmission fluid. yes, it took them that long to figure that out. I was getting the run around buy the dealership by my place so i decided to go across town to the other dealership and they figured it out in 2 hours 
I cant wait to go back to the original dealer and tell them how bad they are at diagnosing c63 amg's. needless to say, for those of you that know about all the problems ive had with that dealership.....they are fired!!

This thread got lost for a while but I will verify that my issues were fixed as well during my 40k service (where they did a tranny service including fluid flush). Not sure if they did anything with the adaptive ecu/tcu but my shifts are always smooth now and the whirring sound I have not heard since.
