MY2012 C63, Transmission in C but ... uses 1st

MY2012 C63, Transmission in C but ... uses 1st
MY2012 C63 Sedan, 5200km.
This has happened 3 times times during the past week.
I start the car, the default puts the transmission in C mode as usual, I start off but I soon notice that the car is in 1st gear (and not 2nd) and won't shift up automatically.
Once I paddle shift it to a higher gear all is well.
This only happens when I start off without first reversing but going into Drive and the car was warm.
I can't reproduce it, but so far 3 occasions in the past few days.
At first I thought it was me pushing the paddle by error but now I observed it happening all by itself.
I phoned the dealer and they will take a look but I can't really reproduce it at will.
Anyone else?

If you are driving in C and give it just enough throttle it will put you in 1st gear... You can demonstrate this by starting out in 2nd stopped then floor it the car will shift to 1st....
C does not = always starting in 2nd gear.
C does not = always starting in 2nd gear.

The thing is it would not upshift at all by itself even when I got well past 1st gear speeds, I had to shift with the paddle, it was like M mode in that way.
