2009 c63 transmission oil leak!!!help

Hi , so one day I realized there's some wet patch that looks like some seepage on the bottom of the transmission oil pan .

I went on to do my regular service , additionally I changed bottom oil pan and gasket everything is new . To my horror about 30min after I drive off smoke starts to come out from the bottom of my car . Turns out the oil was spitting out from the transmission to the hot exhaust causing smokes .

Car is back in the shop they reckon it came from the top of transmission ( transmission breather ) anyone experienced this before ? And what are the possibilities of the oil spitting out frm transmission. ? It seems that it came from the top not bottom pan which I already changed .

Cars feels a pot and drives absolutely fine . Gear changes are perfect and no fault code

Don't the transmission has an overflow pipe for that ? Is there any way to measure the transmission oil ?

To check the tranny fluid level is a pain. Jack up the car, verify the car is perfectly level, start it and warm the tranny fluid up to 45C (use thermocouple on pan or use a pyrometer aimed at the pan). Pull the tranny drain plug with the car running in neutral. If it's overfilled, the fluid will run out of the drain plug. There is a standpipe to set the correct fluid level. When it quits running out, put the plug back in (with the car still running). If nothing runs out, then you need to add fluid and do it all again.

Did you replace the bolts when you changed the "pan"? Also, why did you change the "pan" and not just the gasket and filter?
