Her brother was offering to pay for the repairs He clearly had no idea what the cost was, he was probably only 25 and was wearing a uniform from a retail sales chain. I think I can get the deductible from him with out much drama, I plan on calling him tomorrow.
What I'm getting at is if you bring an action in your name for the deductible, the insurance company may want to tag along or they may want to conduct the claim using a right of subrogation.

Okay, I get it, thanks for the information. I will try to get the deductible without a claim. If I have to file a claim, I will try to go for DV as well.

i wont go into all of our dv details but i can say we asked for 8k and got an offer for 6k. So going to work on something agreeable to me and our ins co. This was on a 65k german suv w 14k damage. Rear ended. So yes you can pursue a dvclaim in tx. Gl

You worked that out with your insurance carrier?
Did you get a professional estimate?

Please keep us posted with how the repairs progress and turn out. Did they also remove your side skirts too? I can't tell if they did or not in the second picture?

Real sad to see it like that. I was rear ended twice in my S550e in NYC, both times were cabs. The damages both were light but still over $12k each. It's really a bad situation to be in... Hope to see her up and running soon.

The side skirts are intact. I have the shop looking up black series parts. Soon I will see if it's feasible.
