2019 C63s faulty after 5 days - AUS syd
I'm new on here, I use to own a rx8, wrx sti, cls63 and a ford ranger which I all adore.
2 years later I've come around to getting back in the game and ordered a new AMG
I was wondering if someone could give me a helping hand or information for the issue that has arisen for me and my brand new car.
3 weeks ago, just picked up my new 2019 sedan C63s from the showroom in Sydney Australia
I have picked it up on a Monday, diving to and from work in normal order as I have to run in the engine.
The following Saturday night was when the problem arose while driving back home after a night out. (the problem happens while im in idle -> acceleration/reverse) I was stuck in traffic and I have my foot on the brake. As I let go of the brake to edge forward I would feel the car pushing forward. I started to notice the RPMs would go up by itself from 800 to 1200 for no apparent reason. (I also made sure at the time my foot wasn't awkwardly on the accelerator and the brake) Mind you I almost hit the car in front of me twice as it just started to happen. I also then noticed when it wasn't doing this it would struggle to get into momentum as if I was driving manual from neutral to first gear trying to accelerate the car and it would jerk a few times then go.
Finally reaching home I then put the car into reverse and it struggles REALLY HARD to move, it had felt like it was going to stall. I would accelerate and the vehicle would not move then suddenly thrust.
I take the car back to the dealership the next day and asked for them to look at it as I was furious what is happening. They told me they didn't have time as service was not open on a Sunday and to come back the next day. I told them the car was not deemed safe to drive and it was a hazard, they thought I was over exaggerating.
Finally, the salesperson that sold me the car said he'll come to take it for a drive around the yard to see what is happening. He noticed there was something that wasn't right about the vehicle, told his manager and said leave it here and they'll take it in for service the following week.
So here I am 2 weeks away from my brand new car that hasn't even hit 100kms on the odometer. Three emails were sent to me since then.
1. First 2 days: We don't know what's wrong
2. Next 3 days : Still trying to figure out what's wrong submitting a sample of engine fluid, and awaiting for Germany to reply back.
3. Latest reply: The next step we need to carry out is an adaptation of the gearbox on cold and when the vehicle is hot. This process does take a few hours to complete. ( aka still not sure what is wrong)
Has anyone come across anything like this or heard a similar story?
In Australia there is nothing such a Lemon Car Law, all we have is ACCC, CHOICE and Consumer Buyers Protection which is really vague and grey.
It is just doing my head in as I have paid good money for a product has had it less than a week, more so they don't even know what is wrong with the vehicle.

PS. when I picked up the car they could not connect the car to Mercedes Me ( a new system ) and still haven't able to.
Is there a mbusa equivalent for Australia? You could try reaching out to them directly (either over phone or email), explain the issue in detail and see what they say? Also having things in writing (eg. emails) might be good just in case you need proof of the concerns you had and you had contacted the MB Australia division to let them know.
Definitely ask your dealership and service department to explain in detail (again in writing) about their diagnosis, and what are the next steps.
Start there and maybe get Mercedes corporate involved.

I understand most of the posts in forums are regarding people experiencing issues (no one posts about how reliable their car is) however reading these types of posts really makes you nervous.
Ironically I waited over 1 year to order the face lift model thinking as most of the teething issues will be rectified however it appears it has gotten worse.
As OP indicated, we don't have lemon law in Australia so you are pretty much screwed if you end with a lemon so I guess all we can do is cross our fingers and hope for the best.
