CLK 430 Cab Brake Lights on without depressing the Brake?

Unusual scenario....Driving behind my wife's car on the way to work this week noticed the brakes lights were on during acceleration and during the day when lights were in the off position....Third light as well`???? Tried to search the archives with no success ....Greatly appreciate your experience

Respectfully,
Deane
