Car Title
I'm going to Birmingham, AL to buy my '99 CLK 430 tomorrow and I have a question. I'll be there after business hours and I'm bringing a cashiers check to pay for the car. Since there is a loan out on the car, I won't be able to get the title, and will have to wait for the seller to go into his credit union and pay off the loan before he can send me the title. I plan on using one of the standard bill of sale agreements for used cars.
My question is, having never done this before, is am I safe in waiting for the title, I assume the bill of sale is a binding legal contract. I have carfaxed the vehicle, and it does not have anything suspicious.

It took my buddy 6 months to get his motorcycle title from the seller after he paid cash for the bike.
The seller (in the photos you put up) looked mature and hopefully everything will work out smoothly.

Go with him to the Credit Union the next day and make sure its noted that in conjunction to the payoff of the loan that the car is being sold to you? The credit union can note that can't they?

Don't exchange any certified funds for anything without a title. I assume youi are an individual, and not a dealer. Are you a Georgia resident? But, everyone met up after hours and Birmingham is 2 hours from Atlanta. We went to his house and stuff.
We'll see, he said this week. Kinda sad really, it's a divorce sale. He sold a restored 1957 Chevy, the CLK430 and soon an old, nice totally restored small block Chevy V8 pick-up truck.

You think her attorney knows about this? Think he might be looking for some proceeds? Hope it works out...have you contacted the lender directly?

that your check was made payable to the seller and the lienholder jointly.....
