Weak A/C on certified car... who's gonna pay?

Weak A/C on certified car... who's gonna pay?

I bought my certified 06 CLK500 last October. Because it was already getting cold I wasn't using A/C much, and wasn't paying attention to it. I noticed it wasn't really cold, but it never bugged me. And then winter came... and lasted pretty much till about now.

Now that the warm weather is here, I noticed my AC can't cool the cabin even on max cool setting... it just runs full blast but it's still pretty warm and uncomfortable in the cabin. The air is cool, not cold.

So I brought my car to the dealership today for Service B, and told them about it. I told them I bought the car in October and the AC was like this since then, and my guess was it wasn't recharged during the certification process.

The dealer rep said it's most likely not a warranty issue... but I think it kind of is, the car was supposed to be recharged during certification, so it this was ommited they should do it now.

What do you think? Who's right and who's wrong? They're going to check AC for any leaks, but in case they don't find any... should I insist that they recharge it, or is this something they're not required to do?

I'm going to hear from them this afternoon... so timely responses would be appreciated. So far I'm really inclined to insist that they recharge it at their cost.

In bold, if that holds true they should pay for the recharge. Fight for it, and use tactics to push them to do so. This is not the first time cars that were supposedly "certified" were nothing but.

I have 2006 CLK500 and mine is CPO car like yours. I have same AC issue, the dealership told me that they will fix it for me. I am dropping the car off next Monday and see how it goes.

They called me back and said they tested the output air temp and it's 30F - as good as it gets. Which I don't get. The air feels tepid rather than cold. My other two cars can give me a frostbite sensation if I put my hand on air vents. Also, they get their cabin to freezing cold temps, and in Mercedes it's not even remotely chilly. I don't know what to do.

Did you set your temp reading to the lowest setting like 60F? Just because the fan at full blast, doesn't mean you gonna get coldest air coming out if your temp setting is at 75F.
