The nightmare is finally over. I picked up the car last week and have already sold it. Although the car was running fine, my problem was that the 3 year warranty I purchased in October of 2023 was in effect gone. The warranty co. called me and said that their limitation of liability was the dealer wholesale value of the car which they deemed to be $31,200 and since the repair was $29,500 their remaining liability for repairs for the remaining term of approx 2 years 9 months is only $1700. So it was a no brainer for me to sell.
Wow, Well I'm glad you don't have to stress over it anymore that's a positive thing at least.
I got my car back a few weeks ago and it is running really well, time will tell whether or not this engine works out or not, I have put just shy of 900 miles on it and all seems to be ok. I purchased a 3rd party warranty that gave me an additional 4yrs 60k miles so at least I will be covered if I have any other mechanical issues.

Fidelity's payout limit is what the customer paid for their vehicle. But correct, like all insurance, the extended warranty company will not pay more than the item being insured it worth.

I bought a certified preowned 2021 BMW 540 with msport package, factory big brakes etc...it's a beast. I am done with Mercedes.
Sorry to hear this but, I can't blame you.
I think the bulk of your aggravation was dealing with the aftermarket warranty company, not Mercedes.
However, Mercedes has a reputation of denial when engine issues arise. Plus providing you with an explanation for this engine failure. Examples are the valve guides and balance shaft sprocket on the early M272 engines.
I "was" considering a '21 CLS450 but now I may do a little more research.
I've owned 3 BMW's and will never own another one. Too damn complicated which results in costly service and repairs.
This is a very long story but I will make it brief. On October 14, 2023 I bought a "certified" preowned 2019 Mercedes CLS 450 from a local dealer here in Carlsbad Ca. ( BMW of Carlsbad) Only 2 weeks later I was pulling into my garage and had turned the radio off and thought I heard a very muted knocking sound coming from the engine. I contacted the dealer and took the car in..and it has been diagnosed with trashed rod bearings. I bought an aftermarket warranty through the selling dealer for $6000. and am glad that I did. Of course the warranty people are dragging their feet because the engine replacement cost is $30,179. !! . The engine is now apart at the dealer waiting for the warranty company inspector which may happen today. The dealership ( sales) is treating me poorly and didn't even give me a loaner car and I have been communicating with their corporate office as I believe they should pay my costs for the warranty and I believe they knew or should have known about this problem. There is a lot more to this but I tried to keep it brief. Anyway some picks are attached.
Consider buying 2019 CLS 450 WDD2J5JB6KA035924, one owner by Carfax, 40,000 miles, $34k. The visual check didn't reveal any problems, test drive is good, only 21" wheels are very solid on the road. But I found on vindecoderz.com: - overview report shows engine failed 28/05/19 (8 days after the 1st record on carfax); - detailed report doesn't have the engine issue but has possible odometer rollback by around 14,000 miles exactly during the owners change (carfax missing the mileage on this day).

I found more information about the engine issue, looks like it's valid. The engine was stalled/failed at 2,380 miles. Feels like not a good buy. I still cannot believe this - engine, new car, MB
