If the 2008 is like my 2014 E cabriolet that I previously had, and like my current 2017 C cabriolet, the trunk partition must be folded up for the top to work. When the top on my car is up, I get the partition warning if I try to put the top down. Simply folding up the trunk partition eliminates the warning and allows the top to be put down. But that is the opposite of what you describe as you indicate the warning occurs when you try to put the top up. Unless we are using opposite terms to describe opening and closing the top.
