The rear bumper is too far forward..the gap to the rear quarter panel is way off..the tail light gap is uneven.. I Would have a look at the rear bumper reinforcement..Sure looks like it was hit! and NOT repaired properly!

actually i already tallked to the dealer...i took those photos NOW SEND ME $5!! lol yea i brought it up when i told it for a test drive the guy said its clean but i didnt believe him even tho the carfax did say it was clean and had 1 owner 89,000 miles and they want $11,900 more pics that i found on the camera of that car
...but anyways im looking at this other e320 silver exterior and beige interior looks nice 75,000 miles and 1 owner and asking around $11,900

First thing I noticed in the pics were the gap between the rear bumber and the body. That thing was definitely hit and repaired. I bet you THAT was the reason for the car being for sale.
For 11,900 I'd look into getting another car.
