What happens if service can't fix a problem?

I have had a problem with a groaning problem in my steering problem when turning right on my '04 211. It is still under warranty and the best mechanic at the dealership is working on it. It is a very hard problem to diagnose/fix and the measures they have taken thus far have not corrected the problem but they are able to duplicate it and are continuing to pursue a resolution. The car is near the end of the warranty with 49K in miles and I entirely trust and respect the guy that is working on it.

It has been in the shop for the past three weeks which gives you an idea of the struggle we are having so my question is what happens if they can't figure it out? Is it declared a lemon and they replace the car?

I would discuss this with your regional MBUSA Service & Parts Operations Manager (SPOM) whose contact info should be readily given to you by your SA.

Different states have different "Lemon Laws", however, I believe you are limited to an 18 month period after purchase and your vehicle must be unusable for a percentage of that time.

Generally speaking, I don't think you qualify under the lemon laws.. but I'm no expert.

Steering groaning

Have they tried checking the steering per the following technical service bulletins:

P-46_20-16 APR 04 Steering - Leaks at Line/Rack Housing Connection

P-46_20-10 FEB 03 Steering Rack - Connector Leaks

My car also had a groaning noise when turning and the power steering seemed to fail. It turned out that it was losing fluid at the connection to the rack. Maybe this will help.
