Pulled fender

I was making a left turn over some metal plates today where they are doing road construction. The entire intersection was covered with metal plates and the road was so uneven that regardless of going <5mph the suspension compressed enough to come up and pull the inside of the fender. I'm going to take it to a body shop - hopefully it can be repaired without having to do any painting.

Does anyone know if the city is at all liable for the damages?

I know the city is reponsible for damage due to potholes, etc. Normally when they put down metal plates to cover trenches they are laid flat, these plates are laid down so horribly its rediculous. The speedlimit is 40mph through the intersection, if I did 40 I would have destroyed my car.

Since you're in Newport, where did you encounter this?

Also, what do you mean by "pulled fender" ? Do you mind adding photos?

Sounds like you need a skilled paintless dent person!

In my experience, government will deny liability, forcing you to go with an attorney. You'll need to decide if the potential for recovery offsets the cost of the litigation.

I had a similar issue with my 3000GT a few years ago. They were doing construction and it caused my front right tire to rip apart and actually broke the rim in two. Suspension was jacked up and the side skirt ripped off the body.

About $5K worth of damages, but the city was liable and covered everything without even a fight. The main thing for me was that I refused to have the car towed until someone from the city came out and inspected the incident and took pictures. They had no arguement about who was at fault, so they paid with no hassle. Didn't have my car for 3 weeks though.

Unless something like a debris comes and hits you, how did you argue that the city is at fault? Cant one get around the construction material? Can you plz let us know how it happened? I would love to understand the liability of the city. Once a few years back, my car hit the gap between two metal plates that they put on the street and tore the tire. The police argued that i needed to go slower. I was going at 20 whereas the posted was 35. I just assumed that it does not help fighting the city for something like this.

Im up at USC, the roads around here are HORRIBLE. I'll post up some pics tomorrow night.

Same situation, my car hit some metal plates that they put on the street and tore the tire (then the rim and suspension blew up along with it). Oddly, the police didn't show up for this. I didn't even argue my case with the city really. They came out and looked at it afterward and said they would take care of it. I wasn't driving that fast (I don't even drive through puddles with that car, much less speed in construction areas), but they ended up paying for it and sending me an apology letter afterward.

Maybe I just got lucky with the city. Who knows?
