Comfort close/open only works sometimes

Comfort close/open only works sometimes
A 2007 220 CDI. Keeping the key open or close button pressed for some time should engage the comfort open/close. But it only works on some occasions.
I guess it is infrared based, and maybe it has something to do about the light from the sun?
Anyway - can I improve the function to have a better success rate?

If you believe the open close works based on ambient light in the surrounding area, the little window in the door handle is defective. (Test it while the car is in a semi dark garage.)
I found on my '06 that the car must already be locked for the lowering to take place at press and hold at all, and unlocked for the press and hold roll-up to take place.
